Problem with Firstspot 4.0.1 fssendmail.exe error

Hi, We've been using Firstspot advanced edition for a few months now at one of our hotels and we need to purchase licenses to deploy to our other 2 hotels. We are however experiencing a problem that has stopped us from doing so. We're running WIndows XP Pro with 4.0.1 Advanced- no other application is running on the windows xp machine. Approx once every 1 to 10 seconds, we get an error message popping up on the screen saying that fssendmail.exe has caused an error and needs to be shut down.

It was suggested to us that we upgrade to the latest version of the software which is 4.0.9. We currently do not have maintenance but if we need to purchase it to fix the problem we will.

Here's my question- if we download version 4.0.9, will our current 4.0.1 license work with 4.0.9, and will it solve our problem. Also, will upgrading to 4.0.9 erase the existing user accounts that is in the database? Thank you.
